Content: Dear Yabola Customer Service,I am writing to formally file a complaint regarding the Yabola T9 Earbuds I purchased from your platform on 15 July 2024 under the order number 028-5668018-7258752. The product is not functioning as advertised, and I believe this issue falls under the protection of EU consumer law.Nature of the ProblemThe product was advertised as providing up to 5 hours of listening time per charge. However, one earbud fails after only 15 minutes of use, and the other lasts for about one hour. This significant deviation from the advertised battery life renders the product unsuitable for its intended purpose.Despite multiple attempts to recharge the earbuds and their case, the problem persists. When I place either earbud into the charging case, the case flashes green 4 or 5 times, and the earbuds themselves flash twice, indicating a malfunction. This suggests a defect either in the battery or the charging mechanism.Legal Basis for the ComplaintUnder EU law, specifically Directive (EU) 2019/771 on the sale of goods, I am entitled to receive goods that are in conformity with the contract. According to Article 5 of the directive, goods must: Be as described and match the advertised specifications. Be fit for their intended use, meaning they should work as expected based on how they were marketed.In this case, the Yabola T9 Earbuds do not conform to the advertised battery life of 5 hours. This constitutes a breach of contract, as outlined under the directive.Furthermore, Article 10 of Directive (EU) 2019/771 provides that, in the case of non-conformity, I am entitled to have the goods repaired, replaced, or to receive a refund. As the product was faulty upon delivery and remains so after my attempts to troubleshoot the issue, I request that you either: Replace the defective earbuds with a fully functional pair, or Refund the purchase price in full.Resolution RequestedI request that you resolve this issue promptly in accordance with your obligations under EU law.
